Commentators have generally been content to cite parallels for the phrase iucunda uoluptas at Propertius 1.10.3 without drawing attention to an interesting resonance which it may evoke.

The underdetermination of theory by data obtains when, inescapably, evidence is insufficient to allow scientists to decide responsibly between rival theories. One response to would-be underdetermination is to deny that the rival theories are distinct theories at all, insisting instead that they are just different formulations of the same underlying theory; we call this the identical rivals response. An argument adapted from John Norton suggests that the response is presumptively always appropriate, while another from Larry Laudan and Jarrett Leplin suggests (...) that the response is never appropriate. Arguments from Einstein for the special and general theories of relativity may fruitfully be seen as instances of the identical rivals response; since Einstein’s arguments are generally accepted, the response is at least sometimes appropriate. But when is it appropriate? We attempt to steer a middle course between Norton’s view and that of Laudan and Leplin: the identical rivals response is appropriate when there is good reason for adopting a parsimonious ontology. Although in simple cases the identical rivals response need not involve any ontological difference between the theories, in actual scientific cases it typically requires treating apparent posits of the various theories as mere verbal ornaments or computational conveniences. Since these would-be posits are not now detectable, there is no perfectly reliable way to decide whether we should eliminate them or not. As such, there is no rule for deciding whether the identical rivals response is appropriate or not. Nevertheless, there are considerations that suggest for and against the response; we conclude by suggesting two of them. (shrink)

In the clinical setting, questions of medical ethics raise a host of perplexing problems, often complicated by conflicting perspectives and the need to make immediate decisions. In this volume, bioethicists and physicians provide a nuanced, in-depth approach to the difficult issues involved in bioethics consultation. Addressing the needs of researchers, clinicians, and other health professionals on the front lines of bioethics practice, the contributors focus primarily on practical concerns -- whether ethics consultation is best done by individuals, teams, or committees (...) how an ethics consult service should be structured the need for institutional support and techniques and programs for educating and training staff -- without neglecting more theoretical considerations, such as the importance of character or the viability of organizational ethics. The term 'systems theory' is used to characterize a set of disparate yet related approaches to fields as varied as information theory, cybernetics, biology, sociology, history, literature, and philosophy. What unites each of these traditions of systems theory is a shared focus on general features of systems and their fundamental importance for diverse areas of life. Yet there are considerable differences among these traditions, and each tradition has developed its own methodologies, journals, and forms of anaylsis. This book explores this (...) terrain and provides an overview of and guide to the traditions of systems theory in their considerable variety. The book draws attention to the traditions of systems theory in their historical development, especially as related to the humanities and social sciences, and shows how from these traditions various contemporary developments have ensued. After a few preliminary remarks concerning Martin's working model, we focus the majority of our commentary on the notion of “consensus,” which is at the heart of her “ethical consensus method,” and the three approaches from which it is drawn. Purpose Although surrogate decision-making is prevalent in intensive care units and concerns with decision quality are well documented, little is known about how clinicians help family members understand the surrogate role. We investigated whether and how clinicians provide normative guidance to families regarding how to function as a surrogate. Subjects and methods We audiorecorded and transcribed 73 ICU family conferences in which clinicians anticipated discussing goals of care for incapacitated patients at high risk of death. We developed and applied a (...) coding framework to identify normative statements by clinicians regarding what considerations should guide surrogates’ decisions, including whether clinicians explained one or more of Buchanan and Brock’s three standard principles of SDM to family members. Results Clinicians made at least one statement about how to perform the surrogate role in 24 conferences ). We observed three general types of normative guidance provided to surrogates, with some conferences containing more than one type of guidance: counselling about one or more standard principles of SDM ; counselling surrogates to make decisions centred on the patient as a person, without specifying how to accomplish that ; and counselling surrogates to make decisions based on the family’s values. Conclusions Clinicians did not provide normative guidance about the surrogate role in two-thirds of family conferences for incapacitated patients at high risk for death. When they did, clinicians’ guidance was often incomplete and sometimes conflicted with standard principles of SDM. Future work is needed to understand whether providing explicit guidance on how to perform the surrogate role improves decision-making or mitigates surrogates’ psychological distress. (shrink)

Strawson's view on punishment has been either neglected or recoiled from in contemporary scholarship on ‘Freedom and Resentment’ (FR). Strawson's alleged retributivism has made his view suspect and troublesome. In this article, we first argue, against the mainstream, that the punishment passage is an indispensable part of the main argument in FR (section 1) and elucidate in what sense Strawson can be called ‘a retributivist’ (section 2). We then elaborate our own hypothesis of symbolic retribution to explain the continuum between (...) moral reactive attitudes and punishment that Strawson only adumbrates (section 3). After this justification of the punitive response to wrongdoing, we compare and contrast our specific kind of retributivist hypothesis with other positions in the so-called ‘new retributivism’ (section 4). Our hypothesis differs from other subvarieties of expressive retributivism in putting centre stage the idea of punishment as taking up a reverential stance towards the victim. (shrink)

Institutional review boards are almost universally considered to be overworked and understaffed. They also require substantial commitments of time and resources from their members. Although some surveys report average IRB memberships of 15 people or more, federal regulations require only five. We present data on IRB meetings at eight of the top 25 academic medical centers in the United States funded by the National Institutes of Health. These data indicate substantial contributions from primary reviewers and chairs during protocol discussions but (...) little from other members, which implies that it may be possible for smaller IRBs to accomplish the same tasks with no reduction in the quality of review. In accordance with ethical principles and standards, researchers conducting studies with children are expected to seek assent and respect their dissent from participation. Little attention has been given to assent and dissent in research with toddlers, who have limited cognitive and emotional capabilities. We discuss research with toddlers in the context of assent and dissent and propose guidelines to ensure that research with toddlers still adheres to ethical principles. These guidelines include designing engaging studies, monitoring refusal and distress, and partnering (...) with parents. Research with toddlers requires flexibility and creativity to respect toddlers in the context of their developmental capabilities. (shrink)

Hedgehog proteins are of pivotal importance for development and maintenance of tissue patterns in adult organisms. Despite the role of Hedgehogs in differentiation and tumorigenesis, signal transduction of Hedgehog remains a relatively uncharted area of signalling biochemistry. For proper Hedgehog distribution into tissues, two highly unusual covalent modifications are necessary, palmitoylation of a secreted protein and the attachment of a cholesterol group, making Hedgehog the only established sterolated protein in nature. Hedgehog exerts its function via two membrane‐bound receptors, Patched and (...) Smoothened; presumably, Patched transports a cholesterol derivate out of cells which inhibits Smoothened. Binding of Hedgehog to Patched impedes this proposed pump function and thus Inhibition of Smoothened, which leads to expression of genetic Hedgehog targets via relief of transcriptional repression. Sir Karl Popper is well known for explicating science in falsificationist terms, for which his degree of corroboration formalism, C(h,e,b), has become little more than a symbol. For example, de Queiroz and Poe in this issue argue that C(h,e,b) reduces to a single relative (conditional) probability, p(e,hb), the likelihood of evidence e, given both hypothesis h and background knowledge b, and in reaching that conclusion, without stating or expressing it, they render Popper a verificationist. The contradiction they impose is easily (...) explained--de Queiroz and Poe fail to take account of the fact that Popper derived C(h,e,b) from absolute (logical) probability and severity of test, S(e,h,b), where critical evidence, p(e,b), is fundamental. Thus, de Queiroz and Poe's conjecture that p(e,hb) = C(h,e,b) is refuted. Falsificationism, not verificationism, remains a fair description of the parsimony method of inference used in phylogenetic systematics, not withstanding de Queiroz and Poe's mistaken understanding that "statistical" probability justifies that method. Although de Queiroz and Poe assert that maximum likelihood has the power "to explain data", they do not successfully demonstrate how causal explanation is achieved or what it is that is being explained. This is not surprising, bearing in mind that what is assumed about character evolution in the accompanying likelihood model M cannot then be explained by the results of a maximum likelihood analysis. Through the thickets of recent debates, I take two facts as clear enough starting points. The first is that Heidegger’s participation in National Socialism, and especially his remarks and pronouncements after the war, were, and remain, horrifying. The second is that Heidegger remains of the essential philosophers of our century; Maurice Blanchot testifies for several generations when he refers to the “veritable intellectual shock” that the reading of Being and Time produced in him.5 And Emmanuel Levinas, not hesitating to express (...) his reservations about Heidegger, can nevertheless bring himself to say that a person “who undertakes to philosophize in the twentieth century cannot not have gone through Hiedegger’s philosophy, even to escape it.”6 In this century, perhaps only Ludwig Wittgenstein has had a comparable impact and influence on philosophy. I do not mean to deny that one can reject the over seventy volumes of Heidegger’s Gesamtausgabe as worthless, that one can, as with Wittgenstein, find that his work is obscure, indulgent, impossible to read, that nothing in it contributes to philosophy. But both Heidegger and Wittgenstein write in anticipation of this reaction, recognizing that their desires, differently articulated, to overcome philosophy will help to determine how their writing is received. Stanley Cavell’s characterization of Wittgenstein’s Philosophical Investigations describes Heidegger as well:Philosophical Investigations, like the major modernist works of the past century at least, is, logically speaking, esoteric. That is, such works seek to split their audience into insiders and outsiders ; hence they create the particular unpleasantness of cults ; hence demand for their sincere reception the shock of conversion.7When combined with Heidegger’s political engagement, the particular unpleasantness of cults and indifference are more than joined. Thus it can seem as though one must either exculpate Heidegger, explain away his relation to Nazism as an aberration from the outside, or reject his thought entirely, declare that his books should no longer be read. Anyone who aims to translate Hegel into readable English should bear in mind what he said in an early essay, viz. that before the living spirit which dwells in a philosophy can reveal itself it must be brought to birth by a kindred spirit. His approach to Hegel will therefore be sympathetic and in order to grasp the full import of what he is saying will try to think along with him, will try to become, as G.R.G. Mure said, an (...) actor in the dialectic. Then Hegel will be no more difficult to read in English than in German. The difficulties associated with his style and terminology are, in my opinion, exaggerated. Professor James Doull rightly says that just because Hegel’s terminology is thoroughly systematic, it is intelligible directly in a given passage to one who is at home in it. Differences in vocabulary and syntax are no barrier to the adequate expression of philosophic truth. In this connection it would be interesting and perhaps amusing if we could have Hegel’s comments on the biassed views of his Dutch disciple G.J.P.J. Bolland who founded a Hegelian school in Leiden at the beginning of this century. In a collection of his sayings occurs the following: “Honour to whom honour is due. Great is the spirit of Hegel - but in-the first decade of the twentieth century pure reason speaks the language of Holland and Bolland.” In a correspondence with Francis Sedlak in 1911 he stated that “even the language of Hegel is inferior to Dutch” and referred to English as a “semi-barbarous language in which the finest things cannot be said.”. We consider equational theories for functions defined via recursion involving equations between closed terms with natural rules based on recursive definitions of the function symbols. We show that consistency of such equational theories can be proved in the weak fragment of arithmetic S 1 2 . In particular this solves an open problem formulated by TAKEUTI (c.f. [5, p.5 problem 9.]).
